Repeal Prop H8? It’s More Possible Than You Think.

Right now, I have no clue how the California Supreme Court will rule on the Prop H8 lawsuits. Maybe we’ll win, maybe we’ll lose. However, I’m really starting to think we have a better chance of winning at the ballot box than I did just days ago. Here, take a look at the new Field Poll published in today’s San Jose Mercury News.

If given another say on same-sex marriage, California’s electorate would be even more divided today than it was in November when a gay marriage ban passed with 52 percent of the vote, according to a poll released Tuesday.

The Field Poll of 761 registered voters found that 48 percent of those surveyed would support a new ballot initiative repealing Proposition 8, while 47 percent would favor keeping the ban in place. The remaining 5 percent were undecided. [...]

“We certainly don’t want to prejudge the judges,” said Marci Solomon, marriage director of the gay rights group Equality California. “If we don’t prevail, we’re committed to seeing the right of same-sex couples to marry restored. We are really evaluating, analyzing when that would be.”

As with last November’s vote, there are deep fault lines on the marriage issue that fall along lines of age, ideology, and religion. But clearly, we’re making progress. And if we continue this pace of progress in the next 18 months, we can actually see the voters overturn H8 next year if the court doesn’t… Or see the voters rebuff any retaliatory effort from pro-H8 forces if the court overturns the marriage ban.
